The Islamabad High Court has dismissed a plea seeking the disqualification of PTI Founder Imran Khan in the Tyrian White case.
A new three-member larger bench of the Islamabad High Court, headed by Justice Tariq Mahmood Jahangiri, heard the disqualification petition of Imran Khan for allegedly concealing his daughter, Tyrian Jade White, in his nomination papers for the 2018 general elections.
The bench also comprised Justice Arbab Mohammad Tahir and Justice Saman Rafat Imtiaz. Khan's lawyer, Naeem Panjotha, presented the arguments.
As the hearing began, the petitioner's lawyer, Hamid Ali Shah, said Salman Akram Raja had asked for an extension in the case. Panjotha argued that the matter had already been decided, and the decision was uploaded to the website. After the decision was removed from the website, the bench was reconstituted through a press release.
Justice Jahangiri asked Panjotha if he was the lawyer in this case. The latter responded that he was the proxy counsel.
The court said that two judges, Justice Mohsin Akhtar Kayani and Justice Arbab Muhammad Tahir, had given an opinion on this case. At this, Advocate Shah said there was an opinion of the two judges in this case, while it was not signed by the chief justice.
Justice Jahangiri said that two members of the bench said the application should not be heard, but dismissed. Chief Justice Aamir Farooq had recused himself from the bench.
Shah asked for a date when he could assist the case. At this, Justice Jahangiri asked how relief can be given on an application that had been dismissed. He said that two judges had given their decision, which was opened in front of everyone today from a sealed envelope.
The court said the petition for disqualification of the PTI founder had already been dismissed by the bench and the majority verdict has been pronounced. Two judges have declared the application inadmissible.
